This Privacy Policy (the “Policy”) explains how Esotericks (“Esotericks,” “we,” “us,” or “our”) collects, uses, discloses, stores, protects, and otherwise processes information submitted to or collected by Esotericks through its website, contact forms, email communications, document submissions, investor inquiries, business inquiries, and related communications (collectively, the “Site” and “Communications”).

By accessing the Site, submitting a form, sending an email, transmitting a document, sharing a file, or otherwise communicating with Esotericks, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, do not submit information or documents to Esotericks.

This Policy applies to information submitted by prospective investors, business contacts, service providers, applicants, website visitors, representatives, advisers, and other persons who communicate with Esotericks. This Policy does not replace or limit any separate investor privacy notice, subscription document, fund document, confidentiality agreement, nondisclosure agreement, advisory agreement, or other written agreement that may apply to a specific relationship with Esotericks.

 

1. Information We May Collect

Esotericks may collect information that you provide directly, information contained in documents or files you send, information generated through Communications, and certain technical information associated with use of the Site.

Information we may collect includes, without limitation: name, email address, telephone number, mailing address, business address, employer, title, professional background, entity affiliation, investor status, accreditation or qualification information, financial information voluntarily provided to us, source-of-funds or compliance-related information, tax or legal information voluntarily provided to us, communications history, message content, attachments, metadata, file names, document contents, signatures, identification information if voluntarily submitted, and any other information included in forms, emails, documents, files, or messages sent to Esotericks.

Technical and usage information may include IP address, browser type, device information, operating system, referring URLs, pages viewed, dates and times of access, approximate location derived from technical data, cookie identifiers, analytics information, security logs, and similar information generated through normal website operation.

 

2. Documents and Files Submitted to Esotericks

If you send, upload, attach, transmit, or otherwise provide documents or files to Esotericks, those materials may contain personal information, confidential information, financial information, business information, signatures, identification materials, legal documents, tax documents, investor questionnaires, due-diligence materials, portfolio information, bank information, entity formation documents, compliance materials, or other sensitive content.

Esotericks may review, store, copy, analyze, summarize, extract information from, retain, transmit, and use submitted documents and files for the purposes described in this Policy, including evaluating inquiries, performing diligence, assessing eligibility, responding to communications, maintaining records, complying with legal or regulatory obligations, protecting Esotericks’ rights, and administering business operations.

Do not submit sensitive personal information, confidential business information, proprietary materials, government identification documents, tax documents, financial account information, or other sensitive files unless Esotericks specifically requests them or you determine that submission is necessary. Submission of documents does not create an investor relationship, advisory relationship, fiduciary relationship, attorney-client relationship, accountant-client relationship, confidential relationship, or obligation by Esotericks to accept, review, respond to, return, or preserve the materials, except as expressly agreed in a separate written agreement signed by an authorized representative of Esotericks.

 

3. Sources of Information

Esotericks may collect information directly from you, from your representatives, from entities or individuals on whose behalf you communicate, from service providers, from professional advisers, from compliance and diligence vendors, from publicly available sources, from third-party databases, from website technology, and from records generated in the ordinary course of communications with Esotericks.

If you submit information about another person or entity, you represent that you have the authority to do so and that you have provided any required notices or obtained any required consents.

 

4. How We Use Information

Esotericks may use collected information for legitimate business, operational, legal, regulatory, security, and compliance purposes, including to respond to inquiries, evaluate prospective investor or business relationships, assess eligibility to receive additional information, perform due diligence, verify information, communicate with you, maintain records, administer and improve the Site, protect security and integrity, detect or prevent fraud or misuse, enforce rights and agreements, comply with applicable law, respond to legal process, and support ordinary business operations.

Esotericks may also use information to evaluate, develop, improve, test, monitor, and operate internal systems, including automated, quantitative, artificial intelligence, machine learning, analytics, compliance, document-management, communication-management, and security systems, provided such use is conducted for Esotericks’ internal business purposes or as otherwise permitted by applicable law.

Esotericks does not use your submission of a contact form or document as a basis to provide individualized investment advice through the Site. Any investment-related relationship, if one occurs, will be governed by separate definitive documents.

 

5. AI, Automation, and Document Analysis

Because Esotericks is an automated AI-driven investment fund or investment strategy business, Esotericks may use automated systems, artificial intelligence tools, machine learning tools, quantitative systems, document-processing tools, and analytics systems in connection with business operations, compliance review, inquiry routing, document organization, communication management, diligence support, security monitoring, and internal analysis.

Automated tools may summarize, classify, extract, or organize information contained in Communications or submitted documents. Esotericks may also use third-party technology providers to support such processing where appropriate contractual, operational, or security measures are used.

Unless separately disclosed or expressly authorized, Esotericks does not intentionally sell submitted documents or personal information, and does not intentionally use documents submitted through contact channels to train publicly available AI models.

 

6. How We Disclose Information

Esotericks may disclose information to affiliates, owners, managers, employees, contractors, consultants, administrators, technology providers, cloud-service providers, cybersecurity providers, analytics providers, communications providers, document-management providers, compliance vendors, professional advisers, attorneys, accountants, auditors, fund administrators, banks, brokers, custodians, counterparties, regulators, governmental authorities, courts, law enforcement, dispute-resolution providers, and other persons or entities where disclosure is reasonably necessary for the purposes described in this Policy.

Esotericks may disclose information to comply with law, regulation, subpoena, court order, governmental inquiry, examination, audit, investigation, reporting obligation, sanctions requirement, anti-money-laundering requirement, tax requirement, or other legal process. Esotericks may also disclose information where it believes disclosure is necessary or appropriate to protect its rights, property, security, personnel, investors, counterparties, business operations, or the rights and safety of others.

Esotericks may disclose information in connection with a merger, financing, acquisition, restructuring, transfer, sale, joint venture, reorganization, bankruptcy, change of control, assignment, or other business transaction involving all or part of Esotericks or its assets, subject to applicable law and any applicable contractual restrictions.

 

7. No Sale of Personal Information

Esotericks does not knowingly sell personal information for money. Esotericks also does not knowingly share personal information for cross-context behavioral advertising as those terms may be defined under applicable U.S. state privacy laws. If Esotericks changes these practices, it will update this Policy or provide other legally required notice.

 

8. Cookies, Analytics, and Website Technologies

The Site may use cookies, pixels, analytics tools, log files, or similar technologies to operate the Site, maintain security, understand website traffic, evaluate performance, prevent abuse, and improve functionality.

You may be able to limit cookies through your browser settings. Disabling cookies may affect Site functionality. Esotericks does not currently respond to browser “Do Not Track” signals unless required by applicable law.

 

9. Data Security

Esotericks uses reasonable administrative, technical, and physical safeguards designed to protect information in its possession against unauthorized access, disclosure, alteration, destruction, or misuse. These safeguards may include access controls, secure storage, service-provider oversight, technical monitoring, encryption where appropriate, internal restrictions, and security review procedures.

No method of transmission, storage, website operation, email communication, file transfer, or electronic processing is completely secure. Esotericks cannot and does not guarantee that information submitted to or maintained by Esotericks will be immune from unauthorized access, cyberattack, system failure, human error, loss, misuse, or disclosure.

 

10. Retention of Information

Esotericks may retain information and submitted documents for as long as reasonably necessary to fulfill the purposes described in this Policy, including to respond to inquiries, evaluate relationships, maintain business records, comply with legal or regulatory obligations, resolve disputes, enforce rights, support audits, satisfy tax or accounting requirements, preserve evidence, and protect against fraud or misuse.

Retention periods may vary depending on the nature of the information, the context of collection, the existence of a business or investor relationship, applicable legal requirements, regulatory expectations, litigation holds, operational needs, and recordkeeping obligations. Esotericks may retain archival or backup copies where deletion is not technically immediate, provided such information remains subject to appropriate controls.

 

11. Your Choices and Requests

You may choose not to submit information or documents to Esotericks. If you have already submitted information, you may contact Esotericks to request access, correction, deletion, restriction, or other action regarding your personal information. Esotericks will review such requests and respond as required by applicable law.

Esotericks may decline, limit, or delay a request where permitted by law, including where retention is necessary for legal compliance, regulatory obligations, security, fraud prevention, recordkeeping, dispute resolution, contractual rights, business operations, or protection of Esotericks’ rights or the rights of others.

12. U.S. State Privacy Rights

Depending on your state of residence and the nature of your relationship with Esotericks, you may have rights under applicable U.S. state privacy laws, including rights to know, access, correct, delete, obtain a copy of, or limit certain uses or disclosures of personal information.

Esotericks will honor legally required privacy rights where applicable. Certain information may be exempt from some state privacy laws, including information governed by financial privacy laws, securities laws, anti-money-laundering requirements, investor recordkeeping rules, business-to-business exceptions, employment-related exceptions, legal privilege, or other statutory exemptions.

 

13. Financial Privacy and Investor Records

If you become an investor, prospective investor, beneficial owner, authorized representative, or related party in connection with an Esotericks investment vehicle, additional privacy notices, subscription documents, fund documents, investor agreements, regulatory disclosures, or other legally required notices may apply.

Certain financial institutions, investment advisers, brokers, dealers, funds, transfer agents, and related entities may be subject to federal or state financial privacy, safeguards, disposal, cybersecurity, incident-response, recordkeeping, or customer-notification requirements. This Policy is intended to operate consistently with applicable law but does not itself determine whether any particular regulatory regime applies to Esotericks or to any specific relationship.

 

14. International Visitors

The Site and Esotericks are operated from the United States. If you access the Site or submit information from outside the United States, you understand that your information may be processed, stored, and transferred in the United States or other jurisdictions where Esotericks or its service providers operate.

Privacy laws in the United States and other jurisdictions may differ from the laws of your country of residence. By submitting information to Esotericks, you acknowledge such processing and transfer, subject to applicable law.

 

15. Children and Minors

The Site is not intended for children or minors. Esotericks does not knowingly collect personal information from individuals under the age of 18. If Esotericks learns that it has collected personal information from a minor without appropriate authorization, Esotericks may delete such information or take other appropriate action.

The Site may contain links to third-party websites, platforms, tools, email providers, hosting providers, file-transfer services, analytics services, or other external resources. Esotericks is not responsible for the privacy, security, content, policies, or practices of third parties.

Your use of third-party websites or services is governed by the applicable third party’s terms and privacy policies.

Submission of information or documents to Esotericks does not, by itself, create a confidential, fiduciary, advisory, attorney-client, accountant-client, or privileged relationship. Information may be treated as confidential only to the extent required by applicable law or expressly agreed in a separate written agreement signed by an authorized representative of Esotericks.

Even where Esotericks applies reasonable confidentiality measures, Esotericks may disclose information as described in this Policy, including to service providers, advisers, regulators, governmental authorities, courts, auditors, or other parties where reasonably necessary or legally required.

 

18. Changes to This Policy

Esotericks may amend, update, or replace this Policy at any time. The updated Policy will be effective when posted on the Site or otherwise made available, unless a later effective date is stated.

Your continued use of the Site or continued submission of information after an updated Policy is posted or made available constitutes your acknowledgment of the updated Policy.
